Terms of Service

Who we are and what PayCan is

PayCan is a brand of E-Smart Technology UK Ltd, a technology company. PayCan provides software. It is not a bank, custodian, money services business or financial adviser, and it does not hold your funds or crypto. Your crypto is safeguarded by regulated, institutional-grade custody partners, and regulated services are provided by licensed third parties under their own licences. Transactions on public blockchains are irreversible, so always check the details before you approve.

1. Acceptance of these terms

By downloading, accessing or using PayCan, you agree to these terms. If you do not agree, do not use the app or the website.

2. Who we are and our role

PayCan is operated by E-Smart Technology UK Ltd, a company registered in England and Wales (company number: 16724966). We build the app and CAN AI and connect you to licensed third-party providers. We do not hold, control or take custody of your funds or crypto, and we do not ourselves provide regulated financial services.

3. Eligibility and availability

PayCan is available in the UK, Singapore, Hong Kong and Latin America, and is not offered in restricted or sanctioned jurisdictions. You must be at least 18 and not barred from using the service under any law that applies to you. Certain features, such as on and off-ramp, accounts and cards, require identity verification through our licensed partners before you can use them.

4. Your account and responsibilities

You are responsible for the security of your device, your sign-in credentials and your account, and for the accuracy of the instructions you give, including those you give to CAN AI. You agree to provide accurate information and to keep it up to date. CAN AI proposes actions and only carries them out after your explicit approval.

5. Custody of your assets

Your crypto is held by regulated, institutional-grade custody partners selected by us. PayCan does not hold or control your assets. The custody and movement of assets are subject to the relevant partner's terms in addition to these terms.

6. Third-party regulated services

Fiat on and off-ramp, account and banking services, card issuing, custody and yield opportunities are provided by licensed third parties under their own licences and terms. Those services may carry their own fees, limits and risks, and may be subject to verification, approval and availability. We are not responsible for the acts or omissions of these partners, although we will help connect you and pass on the information they require.

7. CAN AI

CAN AI is an assistant that helps you understand and act on your money. It provides information and suggested actions, it acts only on your instructions and with your explicit approval, and it does not provide financial, investment, legal or tax advice. You remain responsible for the decisions you approve.

8. Acceptable use

You agree not to use PayCan for any unlawful purpose, including money laundering, terrorist financing, fraud or sanctions evasion, and not to misuse, copy, reverse engineer or interfere with the app, the website or our systems. We may suspend or close access where we reasonably believe these terms or applicable law are being breached.

9. Risk warning

Crypto assets are volatile and their value can fall as well as rise. Crypto is largely unregulated in many places and is not covered by deposit-protection or investor-compensation schemes such as the UK's FSCS. Blockchain transactions are irreversible, and converting between crypto and fiat carries price and timing risk. Yield is not guaranteed and depends on third parties. Only commit funds you can afford to lose, and seek independent advice if you are unsure.

10. No financial advice

Nothing in PayCan or on this website is financial, investment, legal or tax advice or a recommendation to buy, sell or hold any asset. You are responsible for your own decisions.

11. Intellectual property

PayCan, CAN AI, our logos and the content of the app and website are owned by E-Smart Technology UK Ltd or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to use the app for its intended purpose. You may not use our trademarks without our written permission.

12. Fees

Any fees that apply to features or to partner services will be shown to you before you confirm a transaction. Partner services may carry their own fees set by those partners.

13. Limitation of liability

To the maximum extent permitted by law, E-Smart Technology UK Ltd is not liable for losses arising from blockchain transactions, market movements, your own instructions or credentials, or the acts, omissions or services of third-party partners. Nothing in these terms excludes liability that cannot be excluded by law.

14. Indemnity

You agree to indemnify E-Smart Technology UK Ltd against claims, losses and costs arising from your misuse of the service or your breach of these terms or of applicable law.

15. Changes to the service and these terms

We may update the service and these terms from time to time. We will post the updated terms here and change the date above, and significant changes will be notified in the app or by email where appropriate. Continued use after changes take effect means you accept the updated terms.

16. Governing law and disputes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer rights you have in your country of residence.

For questions or complaints about these terms or the service, email legal@paycan.ai. Complaints about a regulated service provided by a partner may also be raised with that partner, who is responsible for that service.
